By creating an account or using the Platform, the User agrees to be legally bound by this Agreement.
1. Definitions
- Platform: The Bling application and website.
- User: Any individual who creates an account on the Platform and may act as buyer and/or seller.
- Product: Luxury goods including but not limited to watches, bags, jewelry, accessories, and similar high-value items.
2. Acceptance of Agreement
By creating an account or using the Platform, the User agrees to be legally bound by this Agreement.
3. Unified Account Structure
The Platform operates under a unified account model, allowing Users to buy and/or list Products for sale using the same account.
Seller obligations automatically apply upon listing a Product.
4. Listing Types, Commission, and Payment Holding
The Platform may allow different methods for listing and selling products. The applicable commission structure and payment settlement terms shall apply according to the type of listing used.
4.1 Self-List - 10% Commission
Sellers may independently list their products on the platform by uploading product information, images, and pricing. The seller is responsible for the accuracy and completeness of the provided information. A commission of 10% will be charged on the final sale price.
4.2 White Glove Listing - 15% Commission
The platform may provide a white glove service where the platform assists the seller in preparing the product listing, including photography, product data entry, verification, and listing optimization. A commission of 15% will be charged on the final sale price.
4.3 Consignment - 20% Commission
Under the consignment model, the seller may deliver the product to the platform or its designated partner for storage, authentication, and sale on behalf of the seller. A commission of 20% will be charged on the final sale price.
4.4 Platform-Owned Products (Our Products)
The platform may also list and sell products that are owned directly by the platform or its affiliated entities. Such products are not subject to seller commission.
The platform reserves the right to temporarily hold payments made by the buyer for a reasonable period of time for order processing, product verification, delivery confirmation, dispute resolution, or compliance requirements. The seller's payout will be released after successful completion of the transaction in accordance with platform policies.
5. Product Authenticity & Liability
The User listing a Product bears full legal responsibility for authenticity and accuracy of the listing.
All Products undergo strict authentication procedures prior to delivery.
If counterfeit, substitution, tampering, or intentional misrepresentation is detected, the Platform shall immediately suspend the account and refer the User to competent enforcement and judicial authorities in the Kingdom of Saudi Arabia.
6. Delivery, Documentation & Custody
The User must deliver the exact listed Product without substitution or alteration.
The Product must be properly packaged for shipping.
The Platform shall document shipment condition at pickup and upon delivery through photographic or digital recording for verification and evidentiary purposes. The documented condition shall be compared against official listing images and description.
The Product shall be considered under the Platform's custody once delivered to its authorized representative or approved courier.
7. Return & Authenticity Assurance
All Products listed on the Platform undergo strict authentication procedures prior to delivery. The Platform maintains a zero-tolerance policy toward counterfeit items and ensures that only genuine products are shipped.
Return requests are permitted within twenty-four (24) hours from confirmed delivery only in cases of material non-conformity between the received Product and its official listing.
The returned Product must remain unused and in the same condition as delivered.
To raise an authenticity claim, the Buyer must provide reasonable supporting evidence including clear images and a written explanation.
Upon receiving the claim, the Platform shall conduct internal verification procedures.
If authenticity is reconfirmed according to the Platform's standards, the Buyer shall bear all related shipping and inspection costs.
If the Product is determined not to comply with authenticity standards, the transaction shall be canceled and a full refund shall be issued.
The Platform's authentication decision shall be final and binding.
8. Prohibited Conduct & Legal Action
Fraud, chargeback abuse, product substitution, intentional damage, false claims, or any attempt to manipulate the Platform shall constitute a serious legal violation.
The Platform reserves the right to immediately suspend accounts, freeze funds, blacklist Users, and initiate civil and criminal proceedings before competent Saudi authorities.
Such violations may expose the offender to criminal liability under Saudi law, including discretionary penalties in accordance with applicable regulations.
9. Taxes
Commercial sellers are solely responsible for VAT registration and compliance.
Both the seller and the buyer are responsible for maintaining and registering all incoming and outgoing transactions and records in accordance with the requirements of the Zakat, Tax and Customs Authority (ZATCA).
Individual non-commercial sales between private persons are not subject to VAT.
This applies based on current ZATCA regulations, and any future amendments issued by the authority shall automatically apply.
10. Limitation of Liability
The Platform acts strictly as a digital marketplace intermediary.
The Platform's responsibility is limited to facilitating transactions and conducting authentication procedures prior to confirmed delivery.
Upon confirmed delivery, responsibility for the product, including its use, maintenance, modification, or any damage, transfers to the Buyer.
The Platform maintains a strict zero-tolerance policy toward counterfeit or replica products and does not permit listing or sale of non-authentic items.
No product shall be published or offered for sale on the platform without authentication through recognized partners or specialized verification procedures before completing the sale.
In the event of suspected counterfeit products, fraud, or violation of laws or platform policies, the Platform reserves the right to suspend the transaction, withhold funds, cancel the listing, restrict the account, and take necessary action under applicable regulations. The Platform may also cooperate with competent governmental authorities in the Kingdom of Saudi Arabia.
The Platform shall not be liable for misuse, negligence, or damage occurring after confirmed delivery.
11. Governing Law and Legal Enforcement
This Agreement shall be governed by and interpreted in accordance with the laws and regulations of the Kingdom of Saudi Arabia.
Any dispute, violation, fraud, or misuse related to the Platform or its services shall be subject to jurisdiction of competent courts and authorities in the Kingdom of Saudi Arabia.
The Platform reserves the right to pursue available legal actions, including reporting violations to governmental authorities and initiating civil or criminal proceedings where applicable.
All users agree to comply with the laws, regulations, and governmental requirements of the Kingdom of Saudi Arabia, and acknowledge that violations may result in legal accountability.
12. Amendments
The Platform may amend this Agreement with prior notice through the application.
13. Return Policy
The return policy for each product is specified individually on the product page within the platform. By completing the purchase, the buyer acknowledges and agrees to the return policy applicable to that specific product as stated on its page.
14. Final Acknowledgment
I confirm that I have read, understood, and agreed to this Agreement.
15. Failed Delivery & Unclaimed Items
If the Buyer fails to receive the Product or cannot be reached, the Platform reserves the right to return the Product to the seller, store it, or apply storage and handling fees.
If the Product remains unclaimed for a prolonged period, the Platform may take appropriate action, including re-listing, returning, or disposing of the Product in accordance with applicable regulations.
16. Delivery Confirmation Definition
Delivery shall be considered confirmed once the Product is successfully delivered to the Buyer's registered address, as evidenced by the shipping provider, the Platform's delivery confirmation system, or successful verification of a One-Time Password (OTP) provided to the Buyer at the time of delivery.
17. Force Majeure
The Platform shall not be liable for delay or failure in performance resulting from events beyond its reasonable control, including but not limited to natural disasters, governmental actions, system failures, or logistics disruptions.
18. Conflict Resolution Priority
In the event of any conflict between general return policies and any product-specific policies, the Platform's core return, authenticity, and dispute resolution policies shall prevail.
19. Product-Specific Return Policy
Each Product listed on the Platform may have its own specific return policy, which shall be clearly displayed on the Product page.
By completing the purchase, the Buyer acknowledges and agrees to the return terms and conditions applicable to that specific Product.
In case of any conflict, the Platform's core authenticity and dispute resolution policies shall prevail.
